A Construction, Forestry, Mining and Energy Union delegate sacked for abusing and physically threatening his co-workers has won his job back after the Fair Work Commission found the expression "f--king c--t" is common across all walks of life and the employee was "talking out his hat".

The decision has caused shock in legal circles, with one senior lawyer warning it could send the wrong signal on union bullying.
