Notorious Porsche speedster Richard Pusey is set to make another bid for freedom as he had more charges dropped in court.

The millionaire mortgage broker — earlier jailed for filming officers killed in the Eastern Fwy crash in April 2020 — has lodged a bail application with the court.

He will argue at the Sunshine Magistrates Court on Tuesday why he should be allowed to be released back into the community.

Pusey told an earlier hearing how he now went by the pronouns they/them and was trying to organise to be taken to a hospital for gender reassignment surgery.

It comes as the prosecution on Thursday withdrew charges in the Neighbourhood Justice Centre relating to assaults on police, and throwing a missile, namely nitrous oxide, when being arrested at his home in Fitzroy on September 15 last year.

But Pusey was not in court to hear of his win.

After waiting more than 20 minutes for him to join the 10.30am video link to the court, a custody officer told magistrate Noreen Toohey that his four attempts to get Pusey out of his cell had failed.

“Apologies for wasting your time,” the officer said, adding that Pusey had refused to attend.

Ms Toohey opted to proceed in his absence, striking out the charges at the request of prosecutor Bianca Moleta.

“I am sure the information will be conveyed to the accused,” Ms Toohey said.

No reason was given for the prosecution’s move to no longer pursue the case against him.

It comes after charges relating to stalking his neighbours were withdrawn at his last court appearance.

Pusey, 43, had been accused of keeping his neighbours under CCTV surveillance and throwing cat litter and faeces around their Fitzroy homes between May 2020 and September last year.

It was when police went to speak to him about these allegations in September that he lashed out, and was charged with not only the stalking of his neighbours, but also four counts of assaulting an emergency worker on duty.

All of those charges have now been dropped.

But Pusey remains in custody over separate allegations of posting online an image of a dead police officer from the Eastern Freeway crash as part of a review for a Melbourne Porsche dealership on February 7.

Four officers – Glen Humphris, Kevin King, Lynette Taylor and Joshua Prestney – were killed when a truck ploughed into them in the emergency lane of the freeway, where they had stopped Pusey in his Porsche for speeding.

Court documents allege Pusey twice used a carriage service “in a manner which a reasonable person would regard as being menacing”.

On November 25 last year, he allegedly menaced staff at the Australian Financial Complaints Authority, before menacing Porsche customers with his review.
