Fair Work approved ‘opt out’ for penalty rates

The Fair Work Commission has approved a controversial workplace agreement that allows employees to “volunteer” to waive away all their penalty rates to work extra hours.

Queensland-based hospitality group Mantle’s agreement, approved last year, will allow it to continue to avoid paying weekend, evening, overtime and public holiday rates across high-profile Sydney and Brisbane venues, despite the commission terminating a separate agreement last week that legally paid no penalty rates for the past 22 years.
