Toowoomba Court: Major update on alleged murder case of Thor Morgan

A court heard the lawyers of one of the three people charged in relation to the murder of Thor Morgan will attempt to have their charges dropped.

An update was provided to a Toowoomba magistrate in relation to the high-profile murder case of Thor Morgan, who was shot in the head while driving on Ruthven Street, Toowoomba in March 2022

Three people were charged in relation to the alleged murder; Lachlan Mark Freund, 24, Isobel Rose Higgins, 24, and Tina Kathleen Hazard, 36.

Bouchier Khan Solicitor Alysha Jacobsen told the court a no case submission would be made to the court in relation to Ms Higgins, who was charged with accessory to the fact after murder.

Police alleged Ms Higgins provided a false alibi for Lachlan Mark Freund who was charged with murder, arson, weapon possession, and unlawful use.

At the Toowoomba Magistrates Court on Monday morning, June 26, Ms Jacobsen said Darling Downs Barrister Jessica Goldie would compile the no case submission to the court and Mrs Goldie explicitly requested the report not be shared to police prosecution.

Magistrate Louise Shephard said the prosecution also needed to make a submission to the court to outline its position and include the evidence relied upon to substantiate the charge.

Ms Shepard said a full hand up would be provided to the court on September 11, which included the submissions from both parties, so the sitting magistrate could make an informed decision.

The court also heard Ms Hazard’s lawyers received a brief of evidence in relation to her charges, which was murder, unlawful possession of a gun, and unlawful use.

Appearing on behalf of Hans Legal, Brad Skuse said Ms Hazard’s legal team had organised a meeting with her in the coming week to discuss her case.

Police prosecutor Rowan Brewster-Webb noted a DNA statement was still outstanding from the brief of evidence in relation to Mrs Hazard’s case.

Ms Hazard and Mr Freund remain in police custody, however Ms Higgins is on bail.

Ms Hazard will next have her matter mentioned in court on July 17, and Mr Freund on July 27.
