A 24-year-old woman charged with being an accessory after the fact of murder following the shooting death of Thor Morgan 10 months ago has had her case mentioned in Toowoomba Magistrates Court.
Isobel Rose Higgins remains on bail and she was not required to be in court, after first appearing for the charge on August 18, 2022.
Higgins was represented on January 19 by Alysha Jacobsen of Bouchier Khan Lawyers, who said the defence were still waiting for eight police statements.
Ms Jacobsen told the court they had received telephone interceptions and the autopsy report, which were outstanding at the previous court mention, however they were still waiting for reports from investigators and general duty police officers.
Police prosecutor Chris Willson told the court he had contacted the relevant officers, but had not received their statements yet.
As well as the “considerable amount of evidence to go through”, Ms Jacobsen said they were also applying for an expensive case grant with Legal Aid, and requested an adjournment of six to eight weeks for the briefs to be properly reviewed and funding possibly secured.
Police allege Ms Higgins provided a false alibi for Lachlan Mark Freund who has since been charged with murder arising from Thor Morgan’s death.
Mr Freund is alleged to have fired several rounds from a lever-action rifle, one of which hit Mr Morgan in the head as he drove along Ruthven St near Downlands College in the early hours of March 15.
Despite the wound Mr Morgan walked back to his girlfriend’s home in Harlaxton from where an ambulance was called.
He was taken to Toowoomba Hospital where doctors located a bullet lodged in his brain.
Mr Morgan survived for several months before he died in the Princess Alexandra Hospital on May 16.
Goondiwindi woman Tina Kathleen Hazard, 36, has also been charged with murder arising from Mr Morgan’s death and she is currently remanded in custody as was Mr Freund.
Magistrate Clare Kelly said all outstanding statements must be provided by the officers by February 16, with the case to be mentioned again on March 16.
Ms Kelly said it was expected that a plan going forward would be established on the next date to progress the case forward.
Higgins was remanded on bail and has not been required to enter a plea to the charge.
