A Toowoomba man has fronted court after he was seen firing a gun on social media that police later claimed was linked to the shooting death of Thor Morgan.

Police charge second person in relation to murder of Thor Morgan

A man who fired a gun that was later identified as the weapon allegedly used to shoot Toowoomba man Thor Morgan will spend more time behind bars.

Dean Edward Charles Cubby, 34, pleaded guilty to unlawfully possessing and discharging a Category B firearm when he appeared in Toowoomba Magistrates Court on Thursday.

Police prosecutor Sergeant Natalie Bugden told the court Cubby was seen firing the gun at a sign on the New England Highway in a Snapchat video on March 9, 2022.

On July 26, the same firearm was found in a northern branch of the Condamine River, which police have since alleged was the distinctive weapon used in the murder of Thor Morgan.

Mr Morgan was shot in dramatic scenes on Ruthven Street in the early hours of March 15.

Cubby has not been charged in relation to Mr Morgan’s death, and there is no suggestion he is involved.

Cubby’s defence lawyer Claire Graham told the court her client became addicted to drugs following the breakdown of Cubby’s marriage in 2015.

Cubby had spent about four-and-a-half months in custody.

Magistrate Clare Kelly sentenced Cubby to six months jail for the possession charge and nine months jail for the discharging charge, to be served concurrently.

His parole eligibility date was set at October 13.
