Lachlan Mark Freund and Tina Kathleen Hazard remanded in custody on charge of murder

Two people who have been charged with the murder of a man gunned down in dramatic scenes on a Toowoomba street have returned to the city courts. Read the latest.

Two people charged with murder arising from the shooting death of 25-year-old Thor Morgan have had their cases mentioned before Toowoomba Magistrates Court.

Neither Tina Kathleen Hazard, 36, nor Lachlan Mark Freund, 24, were required to appear in person before the court but each had legal representation.

Claire Graham, of Skuse Graham Lawyers, acting on behalf of Ms Hazard’s solicitors Hans Legal told the court she was instructed to ask for an adjournment to after September 29 by which time the defence should have received the police brief of evidence.

Tuesday’s court hearing was the first time Mr Freund’s case had been mentioned before the Toowoomba court following his arrest in Brisbane last month.

Mr Freund was charged after police divers found the suspected murder weapon at the bottom of the Condamine River on July 26.

His solicitor Alan Phillips similarly said he was yet to receive a brief of evidence and sought an adjournment.

Mr Freund is alleged to have fired several rounds from a lever-action rifle, one of which hit Mr Morgan in the head as he drove along Ruthven Street near Downlands College.

Despite the wound Mr Morgan walked back to his girlfriend’s home nearby from where an ambulance was called.

He was taken to Toowoomba Hospital where doctors located a bullet lodged in his brain.

Mr Morgan survived for several months before he died in the Princess Alexandra Hospital on May 16.

A third person, Isobel Rose Higgins, 24, has been charged with being an accessory after the fact of murder with police claiming she had provided a false alibi for Mr Freund.

She has been remanded on bail to appear back in the same court on October 13.

None of the three accused have as yet been required to enter any pleas to their respective charges.

Magistrate Gary Finger remanded Mr Freund in custody with his matters adjourned for committal mention back in Toowoomba Magistrates Court on October 25 while Ms Hazard was remanded in custody with her case adjourned to October 11 for committal mention.
