Wayne Billingsby pleads guilty to kicking women from e-bike at Alexandra Headland

Vigilantes have taken the law into their own hands after bashing a drunk man who kicked two women off of their bike near a surf club.

A court has heard how a “lynch mob” attacked a drunk man because he kicked two women from their bicycle after he was escorted from the Alexandra Headland Surf Club.

Wayne Billingsby suffered his own injuries after the group of vigilantes chased and attacked him following his unprovoked assault on the female bike riders on June 24 last year.

Police prosecutor Pedau Grabbe said the victim was riding her electric bike in the beachside suburb with a passenger when she saw a drunk Billingsby walking on the footpath.

Maroochydore Magistrates Court heard on Friday how the woman slowed her bike down and called out to alert him by saying “excuse me, sorry”. She also rang her bell.

Senior Constable Grabbe said as the women slowly rode past, the Glenview man deliberately kicked out at the e-bike, with his foot connecting with its front wheel.

“What the f--- did you say, learn to f---ing ride,” Billingsby said, the court heard.

This kick caused the bike to fall over with the handlebars hitting the woman, who was steering the bike, in her head and chest. Her passenger who was seated behind also fell on top of the victim.

After the fall, the police prosecutor said the victim felt immense pain and could not move her arms.

Senior Constable Grabbe said Billingsby told police he was drinking at the nearby surf club before he clashed with the girls on the bike.

The court heard the 39-year-old also recalled being chased and assaulted by a group of people afterwards.

He was charged with assault in public while adversely affected by an intoxicating substance and wilful damage. He pleaded guilty in court in court on Friday.

Defence solicitor Rose Killip called it an “incredibly unfortunate series of events” after he was escorted from the surf club.

Ms Killip said Billingsby was also pinned drink driving that night, and after kicking the girls from the bike he was “set upon” by security and nearby punters.

She called it a “very bad night” for the Glenview man, who woke up the next day severely injured with little to no memory of the incident.

The solicitor claimed the 39-year-old did not set out to injure the girls with it being a poor timing of events which lead to the trio clashing near the venue. He also wrote an apology letter.

Magistrate Haydn Stjernqvist accepted Billingsby’s remorse and factored in his extra curial punishment, which included his drink drive charge and being attacked by the “lynch mob”.

The 39-year-old was fined $800 with no conviction recorded. He must also perform 40 hours community service and pay back restitution for the e-bike.
