Harvey Steven Harry Moore faces Gladstone court for assault, failing to leave

Extra security guards were required to control a Central Queensland man who turned belligerent when asked to leave a tavern.

A Central Queensland man has tried to spit at and assault security officers as they tried to remove him and a group of men from a tavern.

Harvey Steven Harry Moore, 22, faced Gladstone Magistrates Court on March 15 for his actions at the Harvey Road Tavern in Clinton last year.

The court heard Moore was part of a group of five men who had been fighting at the Clinton Tavern about 7pm on July 15, 2022.

Police prosecutor Sergeant Merrilyn Hoskins said Moore had become so belligerent that extra security were called as well as the manager.

Sergeant Hoskins said Moore threatened the security staff and so he was required to be physically removed from the tavern.

But when they reached the front door, the group Moore was involved in became physically aggressive.

The court heard Moore removed his shirt, clenched his fist and attempted to swing his hands and slap the security guards.

He also spat in their direction but it did not land on them.

Sergeant Hoskins said Moore had no criminal or traffic history.

Defence Lawyer Stacey O’Gorman, of Macdonald and Michel Lawyers, told the court Moore worked as a fitter and turner.

Ms O’Gorman said Moore was taking medication for bipolar and depression but did not suggest that it had influenced his behaviour at the tavern.

Moore had been binge drinking before the incident.

“He has limited recall of the night but was quite shocked when I showed him CCTV footage of his behaviour, and he was very embarrassed and remorseful when he realised what he had done,” Ms O’Gorman said.

“He instructs me that this was really a blessing in disguise because it woke him up to realising he was drinking too much and that was then affecting his behaviour.”

Moore, pleading guilty to common assault in a public place while adversely affected by an intoxicating substance, as well as failing to leave a licensed premises, was fined $650.

Convictions were not recorded.

Magistrate Edwina Rowan also ordered Moore complete 40 hours of community service.
