Beau Cullum in court for bizarre acts in Yeppoon police cell

A Central Queensland driller has faced court for the bizarre things he did while in a cell at a police station.

Beau James Cullum was arrested and taken to Yeppoon Police Station where a bizarre series of events unfolded.

At 12.55am, police released him from custody and told him that he was free to go.

But instead of leaving, Cullum continued to lay on the ground in a cell and he refused to go.

Police warned Cullum that if he failed to leave, he would be arrested for trespassing.

Cullum still refused to move.

Police gave him multiple further warnings which he disregarded.

At 1.05am, Cullum was arrested for trespassing on police property.

A constable asked Cullum to stand and move towards a police car.

He refused to comply and stayed laying on the ground in the cell.

Cullum was given multiple warnings to move and when he didn’t comply, the constable picked him up and physically carried him from the cell to a police car.

Cullum was then taken to the Rockhampton watch-house and charged.

Cullum, 31, accepted that version of events in relation to the October 2, 2022, incident in Yeppoon Magistrates Court this month where he pleaded guilty to trespass, obstructing police and failing to appear in court.

The court heard that Cullum had failed to appear in court in June, 2023, and a warrant was issued.

He had no criminal history.

Solicitor Rebecca Winning said Cullum, a father who worked as a driller, was currently on Workcover due to bicep issues.

“Essentially these charges have been hanging around for quite some time,” Ms Winning said.

“On the night (of the offending) he unfortunately cannot remember.

“He went out earlier in the night - he generally is not a drinker.

“He only had a couple of drinks and he believes he may have been spiked.

“Ultimately... when he went to Rockhampton watch-house, he then went straight up to ED (hospital emergency department).”

Ms Winning said Cullum had shown her a letter from the emergency department which confirmed his level of intoxication.

“So he was essentially paralytic,” Ms Winning said.

“Unfortunately it’s not a defence - it does however provide some context.”

Prior to sentencing, Magistrate Philippa Beckinsale said it was “a fairly unusual trespass and obstruct (police)” and she didn’t think she had seen one similar before.

She fined Cullum $800 and no convictions were recorded.
