What happens in a criminal trial?

A ROSEBUD boxing trainer has taken the law into his own hands after being delayed at a supermarket queue.

Unhappy with the customer in front chatting away to the cashier, the man lashed out, smacking the other shopper in the head with a milk carton.

The supermarket manager had to intervene, police were called and he was arrested.

Maurizio Gileno pleaded guilty at Dromana Magistrates’ Court to an assault charge yesterday.

The court heard the 59-year-old was shopping at Aldi in Rosebud on July 22 this year when he became impatient.

Upset at what he believed was an unnecessary delay due to shopper and staff small-talk, he remonstrated with a 55-year-old man who was being served.

He then grabbed a milk carton from his groceries and hit the victim over the head with it, causing him to suffer neck pain.

Police were called and Gileno left — without his groceries.

He then returned a few minutes later, telling police he had felt threatened and that he had “pushed” the victim with the milk, not punched him.

The court heard Gileno had a history of serious violence.

His lawyer said he was now a pensioner who gave part-time boxing lessons, and was truly remorseful for the “humiliating” lapse in judgment.

He said his client’s criminal past happened a long time ago when he was an alcoholic and he had now been sober for 17 years.

Magistrate Ross Betts said he had problems getting his “temper under control”, denying defence requests for the matter to be dealt with by way of a good behaviour bond.

“(He) has a history of serious violence, it goes back some years,” Mr Betts said.

Gileno was convicted and fined $1000.
