Revenge porn explained: The disturbing reality behind digital blackmail

In the age of social media, sharing intimate images online without consent is a new phenomenon endangering the lives and reputations of many.

Also known as ‘revenge porn’, the act of sharing or threatening to share an intimate video or image of a person without their consent was turned into a criminal offence in February 2019 by the Palaszczuk Government, in the state’s first laws banning revenge porn.

Since the introduction of image-based abuse laws in 2019, more than 166 offenders have been convicted, with 86 per cent of the perpetrators men.

Carrying a maximum penalty of three years in prison, sharing or threatening to share an intimate image without consent is a serious crime.

Yet, even with harsh penalties in place, revenge porn still continues to happen, with women twice as likely to be the victims of image-based abuse.

JIMBOUR MAN’S ‘EVIL’ REVENGE PORN ACT, DAYS BEFORE STRANGLING EX

A Jimbour man appeared before Dalby Magistrates Court in February, 2023 via video link after hacking into his ex-girlfriend’s phone and distributing naked photos of her, just days before he strangled and attempted to kidnap the woman.

Brock Leslie Marshall, 24, pleaded guilty to distributing intimate images, computer hacking and misuse, using a carriage service to menace and harass, common assault in a domestic violence setting and common assault.

Mr Marshall appeared before court just three months after receiving a five and a half-year jail sentence in November, 2022 on assault charges involving the same woman, the mother of his children.

Police prosecutor Chris Hutchins told the court that Mr Marshall hacked into the woman’s Facebook just days before the abduction attempt in August, 2021 and messaged her from her own account, calling her a “s**t” and threatening to “send your naked photos to everyone you know”.

Mr Marshall published photos of the woman in her underwear on her Facebook profile with one caption reading “I’m open for business”, a court heard.

Later that same day, police discovered Mr Marshall in his Jimbour home and found his mobile search history which included a search for “how to hack someone’s Facebook account”.

In reading the character references submitted by Mr Marshall’s defence lawyer, Magistrate Kyna Morice noted that the documents detailing Mr Marshall’s “good character” were written by people who weren’t aware of his capabilities.

“These references didn’t know of your violent and evil nature behind closed doors,” Magistrate Morice said.

He was sentenced to nine months’ jail for common assault in a domestic violence setting and distributing intimate images, six months for computer hacking and common assault, and was not punished for using a carriage service to menace and harass.

A conviction was recorded.

Mr Marshall has been ordered to destroy all intimate images of the woman within one month of being released from jail.

A Capricorn Coast woman laughed while being questioned by police after posting a naked photo of her ex-partner on social media.

The 45-year-old mother pleaded guilty to contravening a domestic violence order at Yeppoon Magistrates Court on April 21, 2022 after her ex-partner attended a police station on February 23, 2022 to report a breach of the order stating that she had posted a naked photo of him on Facebook.

When being questioned by police about the photo, the woman laughed and said she had done it because the man was continuously calling and harassing her.

Magistrate Jason Schubert told the woman, who had a “short” criminal history that she was lucky she had not been charged with a “far more serious offence”.

When asked how she would feel about an intimate photo of herself being placed online, she replied “embarrassed”.

She was placed on six month probation with conditions.

A conviction was recorded.

SCORNED EX LEAKED EX-PARTNER’S NUDES TO COLLEAGUES

The ex-partner of a Brisbane schoolteacher had a run-in with court after sending nude photos of the woman to her colleagues and her ex-husband.

A Maroochydore man, who cannot be named to protect the victim, appeared before Caboolture Magistrates Court on May 12, 2023 and pleaded guilty to two counts of common assault (domestic violence offence), two counts of distributing intimate images, unlawful stalking (domestic violence offence) and wilful damage (domestic violence offence).

A court heard that the man went to his ex-partners Burpengary East home despite her objections on November 5, 2021 where he proceeded to spit food in her face, attempt to get into bed with her and damaged her belongings, including two pairs of sunglasses, a nightgown and an ornament.

He grabbed the victim’s face and squeezed it as well as grabbed her by the upper arm and pushed her aside, a court heard.

On January 10 and 11, 2022, the man sent a nude image of the female victim to her ex-husband and to her workplace with an email to the woman’s workplace reading “I’d like to inform you that one of your staff has been sending numerous nude photographs to numerous men with her name tag on … I was going to sign my children up until I’d been notified of a teacher doing such things”.

Prosecutor Sergeant Catherine Dryburgh said the photo which accompanied the email pictured “the aggrieved partially naked with her … work badge clearly visible”, calling the act of sending the image to her workplace “emotionally manipulative”.

The man, who works as a plumbing contractor, has an 11-page NSW criminal history for similar offences, a court heard.

The Maroochydore man was sentenced to a two-year suspended sentence and also ordered him to pay a $5045 restitution.

A 37-year-old man from Salisbury appeared before court after sending pictures of his penis to two women on two separate occasions, including a pharmacy worker.

Joshua Paul Nolan fronted Brisbane Magistrates Court on September, 2022 and pleaded guilty to two counts of using a carriage service to menace, harass, or cause offence after sending inappropriate images to two female victims, one on June 7, 2021, the other, September 16, 2021.

The first victim began receiving calls, texts and voicemails from a number she recognised as Mr Nolan’s, one of the messages reading “Are you still my sweetheart?”.

She later received another message containing a picture of his penis which she reported to the police.

The second victim, a pharmacy worker, had talked to Mr Nolan about acquiring a script for Viagra and condoms before providing him with a pharmacy email so he could forward his information relating to the orders.

She later provided him with a pharmacy mobile number after he contacted her inquiring about the script, to which he sent a picture of his penis to the pharmacy mobile.

The worker reported the incident to her manager who took the matter to the police.

Mr Nolan, who had a three-page criminal history was sentenced to a 10-month probation order and a 10-month good behaviour bond with recognisance of $500.

Convictions were recorded.

Monty Charles Chapman-Dynevor, 20, narrowly avoided jail time after he threatened to send explicit images of a woman to other people while he was on probation.

Mr Chapman-Dynevor appeared before Bundaberg District Court via video link from the Bundaberg Watchhouse in June 2022 and pleaded guilty to distributing intimate images and threatening to distribute an intimate image.

The court heard that Mr Chapman-Dynevor had contacted the female victim and threatened to send naked photos of her to other people – images that he had obtained during a previous sexual encounter.

Magistrate John McInnes condemned his actions and noted that the offending occurred while he was on probation before placing him on 12 months probation.

Magistrate McInnes also ordered Mr Chapman-Dynevor to delete the images within one month or his probation would be cancelled and he would be jailed for two years.

Convictions were recorded.

A father of two appeared before Dalby District Court in March 2023 after sending a graphic photo of himself to a police officer pretending to be a 13-year-old girl on Facebook in a two-week undercover operation.

Clayton James Mace, 28 at the time of sentencing, pleaded guilty to using an electronic communication device with intent to procure a person he believed was under 16 to commit a sexual act after sending an image of his penis to what he believed was a 13-year-old girl in October 2021.

Mr Mace, who previously lived in Chinchilla, was contacted by the undercover police officer, who made the fake girl’s age apparent from the beginning of messaging, on Facebook where Mr Mace proceeded to ask the young girl to send naked photos of herself to him.

A court heard that Mr Mace had told the undercover police officer “I want nudes really”, and when asked why by the fake 13-year-old he replied “to help me get horny”.

He proceeded to send a photo of his penis and said he would send a video.

Judge Dennis Lynch told Mr Mace, who had no prior criminal history, that he acknowledged he was “profoundly depressed” prior to the offence due to having no contact with his two kids after the breakdown of his relationship with the children’s mother.

He was sentenced to 200 hours of community service.

No conviction was recorded.

A Moreton Bay mum appeared before court after a revengeful act on her ex-lover where she posted inappropriate pictures of him and a sex tape to her OnlyFans account.

Phybie Marie Sloss, who resides in North Lakes, fronted Pine Rivers Magistrates Court on November 9, 2022 and pleaded guilty to distributing intimate images without consent.

Police prosecutor Sergeant Graham Turner told the court that Ms Sloss had posted three intimate images of the male victim in June 2022, including a video depicting a sexual act between her and the victim to get back at his new partner.

After the victim’s new partner contacted Ms Sloss to take the posts down, another image was posted with a caption reading “this is for you” with a heart emoji, a court heard.

The court heard that the images were reported and taken down by OnlyFans but the video was still available to purchase on Ms Sloss’s account until September, 2022.

Ms Sloss was sentenced to a three months good behaviour with a bond of $300.

No conviction was recorded.

A 57-year-old painter appeared before Mackay Magistrates Court in March 2022 after attempting to sneakily take a photo of two girls wearing swimmers and towels while standing in line in a beachside market.

Matthew Geoffrey Selwood, a father of two, pleaded guilty to observations or recordings in breach of privacy after the upskirting attempt at Seaforth markets on November 7, 2021.

A court heard that Mr Selwood situated himself between the victims who were waiting in line at a market stall before holding his phone at his side trying to take a video of the two girls.

Magistrate Robert Turra said Mr Selwood’s offending was “really appalling behaviour” and “extraordinarily abhorrent to the community”.

Mr Selwood, who claims he was going through a marriage breakdown at the time of offending, entered an early guilty plea, had no criminal history and claimed to have attended four counselling sessions.

He was fined $1000 with no convictions recorded.

A 48-year-old grandmother appeared before court after she sent a naked photo of her ex-husband to his new lover following the breakdown of her marriage.

The mother of three adult children and grandmother of four appeared before Toowoomba Magistrates Court in January 2023 to plead guilty to two counts of using a carriage service to menace and harass and to one count of distributing intimate images to cause distress in relation to threatening messages she sent between March 5, 2022 and August 6, 2022.

A court heard that the woman and her husband had been together since their teenage years when the marriage broke down after the man took up with another woman, causing the woman to send her ex-husband’s new lover threatening messages, prompting the female victim to delete her social media account.

The grandmother continued to make threats including phoning the victim at her workplace, and sending her a full-frontal photo of her ex-husband on August 5, 2022.

Magistrate Louise Shepard accepted that the woman, who had no previous convictions, had offended in a behaviour that was out of character.

She was fined $1500, ordered to be released on a recognisance of $750 and to be on a good behaviour bond for 12 months.

No convictions were recorded.

A female victim found out her 19-year-old ex-partner had shared intimate photos and videos of her when his friends began laughing and making fun of her at a party after the explicit content was shared by her ex on a group chat.

Damian Joshua Hudson, who previously lived in Rockhampton, appeared before Toowoomba Magistrates Court in August, 2022 and pleaded guilty to two counts of distributing intimate images after showing his friends private and personal images and videos of his ex-partner following their break up, sending the content to a group chat on two occasions.

After Mr Hudson sent the content in June 2022, the female victim discovered his offending a few weeks later when his friends made fun of her at a party, joking about her anatomy.

The victim made a complaint to police and police investigations confirmed that Mr Hudson was in possession of the intimate material and had shared it without permission.

Magistrate Kay Philipson told Mr Hudson that his behaviour was “completely abhorrent and inexcusable”.

He was sentenced to 18 months probation, with no conviction recorded.

A Sunshine Coast man appeared before court after sharing explicit content of a young woman with his friends in a “vengeful act” after the female victim allegedly shared a photo of his penis to other people without his consent.

Liam Malcolm Wheeler appeared before Caloundra Magistrates Court on July 6, 2022 and pleaded guilty to distributing an image without consent after he showed his friends an intimate video of a young woman.

Police prosecutor Sergeant Stu Lydford said Wheeler received the video in which “the victim was nude and masturbating”.

“ … the defendant has then sent a photo of himself sitting on the couch with five or six of his friends in the background, he’s replied saying ‘ha ha ha’.” Sergeant Lydford said.

A few days later, the victim received a video from a mutual friend showing Wheeler showing the video to at least two other friends, the court heard.

Sergeant Lydford told the court that during his interview with police, Mr Wheeler had said the woman had shown a photo he’d sent her of his penis to other people without his consent.

Mr Wheeler’s solicitor, Rowena Ferrall, said her client’s actions was “a vengeful act” and “a tit for tat kind of arrangement” that he is remorseful for.

Magistrate Catherine Benson said “the fact it was a tit for tat doesn’t excuse it” and fined Mr Wheeler $1500.

No convictions were recorded.
