A Brisbane man who sent ‘menacing’ pictures of his penis to two different women on two different occasions has appeared in court.
Joshua Paul Nolan, 37, of Salisbury faced Brisbane Magistrates Court on Wednesday, September 28 and pleaded guilty to two counts of using a carriage service to menace, harass, or cause offence.
The court heard the charges related to two separate incidents, on two different dates, and involved two victim women.
Prosecutor Acting Senior Constable Jane Macdonald explained the first offence in time was committed by Nolan on June 7 last year.
Snr Cnst Macdonald said the victim woman began receiving calls and texts, as well as two voicemail messages which she did not listen to, from a number she recognised as Nolan’s.
Nolan’s texts included the question, “Are you still my sweetheart?” which was followed sometime later by another text stating, “I take it as a no”.
“At 3.56am, the complainant received another text message containing a picture of a penis,” Snr Cnst Macdonald said.
“The text included with the picture, ‘Hope you’re settling in well. Sorry we didn’t get to have a proper send-off (wink face emojis). We miss you. Love you gorgeous.’”
The woman received yet another text from Nolan at 9.39am. She did not reply to any text messages and reported the incident to police.
The second incident in time took place on September 16 against an employee at a pharmacy.
The court heard Nolan and the pharmacy employee had a conversation about acquiring a script for Viagra and condoms, during which the worker provided him with a pharmacy email so he could forward her information pertaining to the orders.
The woman later received a phone call from Nolan enquiring about the script and he was provided with a pharmacy mobile number.
A short time later, she saw Nolan had sent a text message to the pharmacy mobile containing a picture of his penis. She reported the incident to her manager, who took the matter to the police.
The court heard he had a three-page criminal history but had not committed any offences like those before the court on Wednesday.
Defence solicitor Steve Erickson said his client, a stepfather of two children, accepted that he sent the texts to the relevant recipients and that they were menacing in nature.
He said Nolan was born in Brisbane and was educated to a Year 10 level, working largely in labour and sales until 2016.
Mr Erickson explained the 37-year-old was under the influence of both drugs and alcohol “quite frequently” when he committed the offences, of which he was “ashamed and embarrassed”.
Magistrate Kyna Morice considered the arguments of both the prosecution and defence and sentenced Nolan to a 10-month probation order and a 10-month good behaviour bond with recognisance of $500 and convictions recorded.
