A woman discovered that her ex-partner had shared an intimate image and video of her when his friends, who had seen the material, started laughing and making fun of her at a party.
The man responsible for the “abhorrent and inexcusable behaviour” faced court on Wednesday where he pleaded guilty to two counts of distributing intimate images.
Toowoomba Magistrates Court was told that following the end of their relationship, Damian Joshua Hudson showed his friends a private and personal image and video of his former partner, sending some of the material to a group chat in June this year.
A few weeks later the victim was at a party where the 19-year-old’s friends started to make fun of her.
Police prosecutor Sergeant Tim Hutton said it was around that time it became known to her that the material had been distributed. The victim made a complaint to police, and investigations on a phone seized from Hudson revealed that he was in possession of the intimate material and had shared it without the victim’s permission.
The court was told while the offending had taken place in Rockhampton, and that he had moved to Toowoomba to be supported by family.
Hudson’s solicitor Alysha Jacobsen submitted that her client was a young man and was “extremely remorseful” for his conduct, which took place while he was intoxicated by alcohol and cannabis.
Ms Jacobsen said her client had been seeing a psychologist and was being medicated for depression and anxiety, but her submission didn’t carry much weight with magistrate Kay Philipson.
“That’s only because he is suffering stress and depression because of his current circumstances, not that it’s got anything to do with this appalling behaviour,” the magistrate said.
The court was told Hudson had written a letter of apology to the victim, which Ms Philipson described as “self-serving”.
“He starts his apology letter by talking about the impact it’s had on him and his family,” Ms Philipson said.
“You have distributed personal private images of your ex-partner among your friends, joking about her anatomy, and the next day you have sent images via Facebook messenger again of your ex-partner, to a group chat.
“Your behaviour was completely abhorrent and inexcusable.”
Hudson was sentenced to 18 months probation, with no conviction recorded.
