Fines a warning to bosses who don’t ask first about working Christmas

BHP must pay almost $100,000 for failing to ask its workforce if they wanted to work on Christmas before rostering them on in a landmark judgment that serves as a warning to employers across the country.

The Federal Court on Tuesday fined the mining giant $15,000 and ordered it to pay $83,700 to 85 workers at its Daunia Mine in Queensland after considering the company deprived them of spending time with their families and observing a key religious holiday, forced them to find babysitters and left their young children devastated.
