Isaac Zane Cubby appears in Toowoomba court via video for mention of murder charge

A teenager charged with murder arising from the death of Robert Brown, who was allegedly knocked down at a taxi rank near Grand Central Shopping Centre, has made his second appearance before Toowoomba Magistrates Court.

Isaac Zane Cubby, 18, has been held in custody since his arrest on February 7 and appeared in court via video link from the prison on Tuesday dressed in prison issue greens.

Robert Brown died as a result of injuries sustained after a fall on Margaret St on February 6, 2023.

He has not as yet been required to enter any pleas to charges of murder, robbery with violence, unlawful use of a motor vehicle and entering a dwelling with intent arising from alleged incidents of February 6 or to a string of unrelated charges which include dangerous operation of a vehicle, burglary, armed robbery and threatening violence.

Police allege Mr Brown, 75, was knocked to the ground and had his bag stolen as he stood at a taxi rank on Margaret Street in Toowoomba’s CBD about 5pm, February 6.

Mr Brown sustained serious injuries in the fall and never regained consciousness, dying in hospital a week later.

During Tuesday’s court appearance, Mr Cubby sat quietly with hands clasped as his solicitor Ryan McCullough, of MacDonald Law, asked for an adjournment to go through the police brief of evidence with his client and take further instructions.

Magistrate Kay Philipson remanded Mr Cubby in custody and adjourned all charges for mention back in the same court on April 28.

Two co-accused teenagers, a 17-year-old Dalby boy and a 17-year-old Harlaxton boy, who were also charged over the incident involving Mr Brown, are progressing their matters through the Toowoomba Childrens Court.
