Well-reported holdups in Queensland’s DNA and autopsy reports were again at the centre of delays in a Miles murder case put before Toowoomba Magistrates Court on Wednesday.

Dale Joram Edward Hamilton, 26, is charged with murder arising from the death of 44-year-old Jonathan Martin who died allegedly as the result of injuries sustained during an argument at a Hawkins St home in Miles on March 21.

Police claim the two were known to each other and the altercation was sparked by an alleged neighbourhood dispute.

When officers arrived at the home about 9.30pm, March 21, Mr Martin was found unresponsive with a wound to his chest.

He later died in Miles Hospital.

Mr Hamilton has been held in custody since his arrest in March and was not required to appear in court when the matter was mentioned on Wednesday.

His solicitor Phil Stainton, of Legal Aid Queensland’s Toowoomba office, told the court the matter had been adjourned previously for DNA and autopsy updates.

However, he said he had been advised that those reports wouldn’t be available until the end of November at the earliest and sought an adjournment to December.

This comes just a week after the state government announced a second inquiry into the state’s forensic DNA testing would be held following revelations some 37,000 cases needed reviewing.

Magistrate Louise Shephard remanded Mr Hamilton in custody and adjourned the case for mention back in the same court on December 6 when it was expected an update on the status of the DNA and autopsy reports would be given.
