Ty Devlin jailed for rape of woman who was passed out from acid

A Brisbane labourer and father of two offered a woman drugs before she passed out and woke up to the man raping her, a court has been told.

A Brisbane labourer offered a woman drugs before she passed out and woke up to the man raping her, a court has been told.

Ty Devlin, 48, pleaded guilty in the Maroochydore District Court on Thursday, January 25, to one charge of rape. He had no supporters in the public gallery.

The court was told Devlin went over to the woman’s house on September 12, 2020, where they had drinks and Devlin offered her the drug acid.

Crown prosecutor Michael Andronicus said the woman had never taken acid before, but accepted nonetheless.

She passed out, and woke to Devlin raping her on her living room floor.

Mr Andronicus said Devlin told her she had fallen, but she didn’t believe him before passing out again.

The next morning she asked him if they had sex and he said “no, not really”, and told her she had fallen over.

Later, in January 2022, the two were talking over Facebook messenger when Devlin told her he remembered “giving it to (her) real good at (her) place” and that she was “out of it and told (him) to stop”.

Mr Andronicus said the victim then replied “rapist”.

Mr Andronicus told the court Devlin told police he didn’t sleep with the victim, but later said he was “absolutely blind” and didn’t remember sleeping with her due to the length of time since it happened.

He later changed his story and said they had consensual sex and denied the woman was unconscious.

But when shown the text messages said they were taken out of context and he was “just joking”.

He was charged and released on bail, only to be remanded in custody in October for breaching bail and allegedly committing drug offences.

He has been in custody since October 11, 2022.

A victim impact statement from the victim said the rape caused her a “lifetime of pain” and it had destroyed her self worth and self love.

Barrister Nathan Turner said his client can’t recall many of the details from the night and had no prior sexual convictions.

The court was told Devlin had been clean from drugs for the last 15 months and had found work in jail. He is a labourer and has two children from a previous relationship.

Judge Glen Cash sentenced Devlin to five years jail, suspended after serving 20 months. The 471 days Devlin has spent in pre-sentence custody was declared time served.
