Developer behind Pelican Waters’ Quay Residences proposal set to take council to court

The developer behind plans to build a large marina village, involving a shopping complex and 40 units, has revealed he intends on taking the Sunshine Coast Council to court.

The developer behind plans to build a large marina village, involving a shopping complex and 40 units, has revealed he intends on taking the Sunshine Coast Council to court over the proposal.

The development application for the site at Pelican Waters was first lodged with the Sunshine Coast Council in 2021, however it was ultimately withdrawn in June this year.

The initial plans for the marina village at 2 The Basin in Pelican Waters only involved the shopping complex, which was granted approval by the council in 2021.

However, updated plans to build 40 residential units above the shopping complex, all including three-bedrooms, were submitted earlier this year.

The updated plans, named Quay Residences, would bring the total height of the four buildings to six-storeys.

The project’s developer, Grant Kennedy, said the plans had been submitted to the council for a second time as he prepares to take the development application the Planning and Environment Court.

“Since then (June 2024) we have sought specialist legal opinion which has confirmed that our application should be code assessable,” Mr Kennedy said.

“Council continues to say that it is impact assessable including the retail component which is already approved.

“Therefore we have re-lodged the application with the intention of taking the issue to the Planning & Environment Court.”

Mr Kennedy said the development, if approved, would help ease the region’s housing crisis and the liveability of the village would reduce the community’s reliance on cars.

“It is unfortunate that a proposal on a site unaffected by amenity issues such as overlooking or blocking views and one that provides all shopping facilities within walking distance to residents, thus reducing car travel and congestion, has to go through his process,” Mr Kennedy said.

“The Sunshine Coast continues to struggle to provide a diversity of accommodation options to the average 10,000 people who move here each year and this is just another example of why this occurs.”

Property data showed the 7,915 square metre block was snapped up by Marina Village Holdings 2 Pty Ltd in February 2021 for $3.7m.
