A driver, who crashed his car into gum trees on a rural Queensland highway has blamed kangaroos and bad choices for the early morning blunder in the Aussie bush.

A disqualified driver has claimed in court he was swerving to miss two kangaroos when he crashed into gum trees at Moura in May.

Joshua Ronald Brickle should not have been driving the night he wrote off his car and fractured his neck.

Not only was he behind the wheel while court disqualified, but he was also on a suspended jail sentence.

Brickle, 35, pleaded guilty in Biloela Magistrates Court on July 5 to disqualified driving.

Police prosecutor Sergeant Kevin Ongheen said on May 11, sometime between 12.01am and 4.30am, Brickle was involved in a single vehicle crash on the Dawson Highway at Moura.

He was taken to Moura Hospital and that’s where police spoke to him.

“ (Brickle) told police he’d been driving and he was the only occupant of the vehicle,” Sgt Ongheen said.

Police checks revealed that Brickle’s driver’s licence was court disqualified until December.

“He said he was aware of this and there was no emergency for driving,” Sgt Ongheen said.

The court heard Brickle had “numerous” prior unlicensed driving offences on his traffic history.

It was told that Brickle’s suspended sentence was for “unrelated” matters.

A self-represented Brickle told Magistrate Philippa Beckinsale he wrote the car off that night.

“If I could take it back, Your Honour, I would,” Brickle said.

“I know that doesn’t change what happened.

“Two kangaroos jumped out, I’ve swerved, hit one, gone off the road and hit two gum trees – fractured both C7 in my neck.”

Ms Beckinsale fined Brickle $750 and disqualified him from driving for two years.
