The tragic truth about road deaths in Australia

A father charged over a devastating crash between Mackay and Rockhampton that claimed three lives, including his two-year-old son’s, was ‘freaking out’ about going to jail, court documents have revealed.

According to court documents, Javarn Roy Doyle, 21, told a woman he had no intention of going back to Rockhampton after being released on bail in Brisbane as his solicitor had advised him he was looking at the possibility of 14 years in jail for vehicular manslaughter.

Mr Doyle had his matters mentioned in Rockhampton Magistrates Court on October 12 where he was charged with more than 20 offences, including four counts of dangerous operation of a vehicle causing death or grievous bodily harm while adversely affected by an intoxicating substance.

He was also charged with eight counts of breach of bail condition, and one count each of failure to appear, contravention of a community service order, contravention of a probation order, driver failed to ensure child over six months but under four years was in child restraint, driving without a licence while demerit point suspended, light vehicle must not be driven on a road if defective, wearing of approved seat belts by passengers 16 years or older and offence of driving while relevant drug is present in blood or saliva as the holder of a learner, probationary or provisional licence.

In an objection to bail affidavit by police, filed with the court and viewed by this publication, an arrest warrant for Mr Doyle was issued on February 22 and he was arrested on June 6 in relation to the crash on Marlborough Sarina Road at Clarke Creek on November 11, 2021.

Mr Doyle allegedly had drugs in his system while he was behind the wheel, travelling from Rockhampton to Nebo with his partner Kira Jasperson, their son Izaya Jasperson and two others, when the car left the road near Grave Gully Bridge and collided with a culvert about 10.15pm.

It is understood the vehicle flipped and rolled in a muddy ditch pinning some passengers under the vehicle.

As a result of this accident three occupants died and another sustained serious injuries.

Izaya and a 59-year-old Park Avenue woman were pronounced dead at the scene.

Ms Jasperson was taken to Rockhampton Hospital with serious head, facial and pelvic injuries from which she later recovered.

According to the court documents, Mr Doyle signed and entered into a bail undertaking at Brisbane Magistrates Court on June 7, which had a number of conditions, including that he report to the North Rockhampton Police Station three days a week from June 10.

The affidavit stated Mr Doyle failed to report to the officer in charge of North Rockhampton Police Station on eight occasions between June 10 and 27.

The court documents state Mr Doyle also failed to appear at the Mackay Magistrates Court on June 28 as required and as a result a warrant was issued.

A police officer attended Mr Doyle’s bail address on French Ave, Frenchville, on July 12 in an attempt to locate him in relation to his outstanding breaches of bail.

The court documents state the officer spoke to a woman who stated her last contact with Mr Doyle was when he attended court in Brisbane in June.

The court documents also state Mr Doyle told the woman he had no intention of going back to Rockhampton as his solicitor had advised him he was looking at the possibility of 14 years in jail for vehicular manslaughter.

The court documents further state Mr Doyle told the woman he was ‘freaking out’ about going to jail and would not hand himself into police after he saw himself on TV and saw he was wanted on a warrant for his arrest.

Police later attended a unit on Macaree Street, Berserker, in relation to locating Mr Doyle.

Mr Doyle was placed under arrest in relation to his outstanding warrants.

The court documents state that from 2017 to 2022, Mr Doyle was granted bail on eight occasions and had been the subject of nine warrants.

Mr Doyle was remanded in custody and his matters were adjourned to November 9.

Mr Doyle also had an attempted robbery in company charge mentioned in Rockhampton District Court earlier this month on October 5, which was adjourned to December 7 for sentencing.
