A teenager accused of two armed robberies in Rockhampton has applied for bail in court.
Bryan Daniel Gulf, 18, appeared in Rockhampton Magistrates Court on November 22 charged with two counts of armed robbery, three counts of unlawful use of a motor vehicle, and one count of stealing.
Police alleged three people threatened a woman with a weapon at a Park Avenue shopping centre before stealing her handbag and vehicle on November 19 about 8.30pm.
It is then alleged the group attended a service station on the Bruce Highway at Marmor and threatened the attendant with a weapon, demanding cash and cigarettes, on November 20 about 1.30pm.
Police prosecutor Tiffany Moras argued bail should be refused.
Mr Gulf’s solicitor, Pierre Lammersdorf, said the objection to bail affidavit outlined “great strength of evidence”, including police allegations his client’s fingerprints were on vehicles, as well as a police allegation that there was CCTV footage that was captured identifying him in the alleged robbery offences along with forensic evidence.
However, Mr Lammersdorf argued there was no evidence before the court to show his client’s fingerprints were on the Mitsubishi ASX that was stolen in the alleged robbery on November 19.
“That would be far more crucial as that would potentially link my client to the robbery,” he said.
He also argued there was no proof it was his client in the CCTV footage of the incident.
“I would suggest that would not mean there is great strength in regards to the robbery, particularly when there were co-offenders allegedly involved as well,” he said.
He argued the risk his client could be placed on strict bail conditions, including wearing an ankle bracelet and reporting to police three days a week.
“The allegations are very serious but there are doubts regarding the strength of the case,” he said.
Acting Magistrate Paul Byrne said the identification of Mr Gulf was a “bland assertion by the author of the bail objection that you are one of three who committed the robbery”.
“I must say the bail objection for offending of this nature is so general and non-specific and lacking in detail,” he said.
“It is just concerning.”
Mr Byrne said there was a “clear lack of link between you and the person that is responsible for the more serious offending”.
He granted Mr Gulf bail with the conditions he live at an address in Koongal, comply with a curfew, report to police at North Rockhampton Police Station three days a week and wear an ankle bracelet.
“If you don’t comply with your bail conditions or you commit another offence, your bail will just vaporise,” he said.
Briefs of evidence were ordered and Mr Gulf’s matters were adjourned to January 17, 2024.
