The case against a man involved in an alleged attack, which left another Hervey Bay man in emergency surgery, has returned to court.
Mahlie Dhunga Muhda Mitija Thanba, 28, is charged with assault occasioning bodily harm after the alleged altercation on Oleander Ave, Scarness on October 14, 2024.
Mr Thanba appeared via video link in front of Magistrate Stephen Guttridge on Thursday morning and was represented by Justin Geldard of Geldard Sherrington Lawyers.
Mr Geldard applied for bail on behalf of Mr Thanba, who had been remanded in custody since his arrest, but the application was contested by police prosecutor Sergeant Kim Harwood.
A bail application was originally made on October 16 but was ultimately denied.
Sgt Harwood told the court Mr Thanba’s co-accused allegedly produced the knife, but he helped him by “repeatedly punching the (alleged) victim in the head”.
It was only after these initial punches that the co-accused allegedly kicked the victim in the head and stabbed him in the torso, she said.
The court also heard Mr Thanba was serving a suspended sentence at the time of the alleged offence and had a “history of bail breaches.”
However, Mr Guttridge granted bail on strict conditions, including not contacting the victim or attending the Oleander Ave address, and not having any contact with the co-accused.
The case was adjourned to February 20, and his file has been transferred to a new law firm, Bell Dore Lawyers.
No plea has been entered.
