A young dairy farmer police allege caused the death of James Andrew Curtis in a pub assault had had his case mentioned in court.

Tinana’s Declan Jamie Thomas Burton, 20, is charged with unlawful striking causing death.

Maryborough Magistrates Court court heard this week a brief of evidence had been disclosed meaning the case can now progress.

Police will allege an argument began between Mr Burton and Mr Curtis outside the Lamington Hotel on Ferry St in Maryborough on November 24, 2023.

Mr Burton, who works at his family dairy Burton’s Milk, allegedly struck 51-year-old Mr Curtis in the head about 10pm, causing him to fall and hit his head on the pavement.

Released on bail just before Christmas, Mr Burton was initially charged with one count of grievous bodily harm, but in the wake of Mr Curtis’ death in hospital on December 7, 2023, the charge was upgraded to unlawful striking causing death.

Mr Burton did not appear in court on Tuesday, and his case was adjourned until March 19, 2024.

His appearance in court was excused.
