A teenager who was sent to Coles to get prawns for his mum, soon found himself in hot water with the security guard, and then with police.

A teenager sent to buy some prawns from Coles for his mum soon found himself in hot water when he entered a Maryborough shopping centre where he had previously been banned.

The court heard on June 13, Smith had gone to Maryborough’s Station Square Shopping Centre, despite the fact that he had been banned.

About 1pm, police were called to Station Square where a security guard said Smith was trespassing at the centre because he’d previously been issued a banning notice.

When the officers arrived, the security guard said he had observed Smith in the shopping centre near the Coles entrance.

He said he had told Smith to leave “numerous times” but he refused to leave and kept walking into Coles.

Smith told the security guard he was getting items for his mother, but the security guard said that he must leave, the court heard.

Smith spoke to police and said he had to go to Coles to get items for his mother.

He said he wasn’t aware he was banned, but later said in an interview that he did know.

The court heard Smith had no prior history of offending.

Defence lawyer Michael Riedel said Smith was living with his grandmother and had severe epilepsy and was in the process of getting a disability support pension.

“He has severe fits every three to four weeks,” he said.

On the day of the offending, Smith had been asked by his mother to go to Coles and get some prawns, Mr Riedel said.

“He has had some issues with that security guard in the past, but in any event he instructs he wasn’t there to cause any trouble or anything like that, he was simply there to buy something for his mother and leave.”

Magistrate John Milburn said Smith was young and understood what he did was wrong.

Smith was placed on a $200 good behaviour bond for two months.

No conviction was recorded.
