A man with a “shocking history” of breaching domestic violence orders has been sentenced in the Dalby Magistrates Court for failing yet again to adhere to court orders.
Jason Neil Poultney on Tuesday pleaded guilty to two counts of breaching a contravention order and one count of possessing a stolen license plate following an incident on July 29, 2024.
The court was told that police had attended the premises of a protected person after a neighbour had called triple-0 upon hearing an argument.
When they arrived police found Poultney at the property, contravening an order made in March 2023 which prevented him from being within 100m of the protected person without written permission.
The court was told when police arrived at the protected person’s property Poultney spoke to them and said she didn't want to come to the door.
Police then entered the property and spoke to the victim who said she and Poultney had an argument about him sleeping all day. She had then asked Poultney to leave the property but he had refused and raised his fist in a threatening manner.
The victim told police she had given him verbal permission to attend the property, however the order required written permission and he had also refused to leave when asked.
While at the home police also located a motorbike with plates which had been reported stolen, with Poultney saying he had purchased the bike off someone and was unaware the plates had been stolen.
In her sentencing remarks magistrate Kathleen Payne took into account Poultney’s “shocking history” of contravening domestic violence orders, having breached them ten times.
She did however acknowledge his efforts to get clean of methamphetamine which she said had contributed to some of his past offending.
“You’ve done well to get off meth, this is an enormous achievement,” she said.
“You need to learn to control your emotions and keep your hands to yourself, it is a learnt skill.”
The protected person appeared in court in support of Poultney and was emotional throughout the sentencing.
For the three charges Poultney was sentenced to four months, six months and one month imprisonment to be served concurrently but was released on parole that day.
A conviction was recorded.
