A man who masturbated inside a female toilet block, after doing the same while watching a woman exercise at Doyle Ground, North Parramatta, has been released from custody without convictions because he suffers from schizophrenia.

The 51-year-old’s charges were dismissed under Section 14 of the Mental Health Act towards the end of the second and final day of a hearing at Parramatta Local Court on Tuesday.

The court heard the unemployed landscaper was diagnosed with the condition while in custody for a series of bizarre September 30 offences at the popular sports ground when he reached into his army cargo pants and masturbated while staring at a woman in her 20s when she exercised with a personal trainer.

The personal trainer blocked her in an effort to protect her from Casey’s obscene act about 8am when several people were exercising at the popular park.

The court heard Casey took ice the night before and followed a nine-year-old girl into the female toilet block at the Buller St park after talking to her father.

The dad gave evidence that he failed to notice Casey enter the female toilets because he was using his mobile phone at the time.

While she was in the first cubicle and Casey entered the third stall, he pulled his pants down and started making coughing and grunting sounds.

He admitted to touching himself because he was aroused from seeing women exercise in the park.

A charge of intentionally carrying out a sexual act with a child under 10 years was dropped because there was no evidence he masturbated when the child was in the toilets.

Magistrate Daniel Reiss said: “At the time he was still aroused about the earlier woman engaging in a workout at the park. There’s a lot of highly sexualised behaviour going on before and after (he enters the toilet block) by the accused.’’

On Monday, a 30-year-old woman gave evidence about how she believed Casey was trying to sell her drugs after he stopped her to talk while she was walking but the charge of intimidating intending fear physical harm was also dismissed.

A charge of sexual touching without consent was also dropped after Casey “pricked” another woman on the shoulder.

He then drove to Brickfield St where he followed a man into a unit block and barged a unit door, causing the lock to crack.

Police were called after he drove to Iron St to visit his GP and mounted a kerb before trying to flee, telling cops he was “being a bird and wanted to fly away” and made bird sounds.

Casey’s shocking behaviour continued when he was arrested and masturbated in the police paddy wagon on the way to Westmead Hospital where he underwent a urine test.

He pleaded guilty to carry out a sexual act with another without consent, stalk/intimidate intend fear physical etc harm (personal), destroy or damage property less than $2000 and sexually touching another person without consent.

His not-guilty pleas including stalking or intimidating to cause fear of physical or mental harm and peep/prying were dismissed.

Casey’s lawyer, Peter Guirguis, said the case’s complexion had changed since his client’s arrest and following the formal schizophrenia diagnosis.

“There is overwhelming evidence that he was in the midst of a psychotic episode,’’ he told the court.

Casey, who was not called to give evidence, had no criminal record, and had a “normal and productive life” before his mental health deteriorated in the lead-up to the offence.

Prosecutor Robert Breckenridge submitted that Casey would not necessarily be compliant with treatment and he had to keep away from children.

But Magistrate Reiss accepted that the state of his mental health must be considered and released him without convictions after nine months behind bars.

Casey must attend Wyong Community Mental Health Service to see a case manager, undertake psychiatric appointments and take medication.
