NRL Canberra Raider Tom Starling and brothers Josh and Jackson’s bail dropped

NRL hooker Tom Starling, 24, and his two brothers will be able to enjoy a festive beverage for the first time in over 12 months after a magistrate eased an alcohol ban on the trio.

It promises to be a more relaxed Christmas at the Starling household with a magistrate easing an alcohol ban on brothers Tom, Jackson and Josh following two `related’ alleged nightclub incidents.

Canberra Raiders hooker Tom, 24, and his brothers, Jackson, 26, and Josh, 21, were not required to appear when their matters were mentioned briefly at Gosford Local Court on Monday.

Tom and Josh have both previously pleaded guilty to one count of intimidation following an incident outside the rooftop cocktail bar Mumbo Jumbos at Terrigal on October 16, 2021.

Following their guilty pleas the brothers each had charges of threatening a witness and behaving in an offensive manner withdrawn and dismissed.

Josh was further charged with resisting or hindering police, which was also withdrawn following his guilty plea.

Meanwhile their brother Jackson has pleaded not guilty to his alleged role on the night, for which he was charged with offensive behaviour and two counts of resisting an officer in the execution of their duty.

The court heard Jackson is listed to face a two-day hearing in relation to those charges in July next year.

Tom and Josh were due to be sentenced for their intimidation charges at Gosford on Monday but the court heard they were still awaiting the outcome of a “related” 11-day hearing in the Downing Centre Local Court following an alleged brawl at Shady Palms nightclub at Kincumber in December 2020.

Tom, Jackson and Josh — along with a fourth man — have each pleaded not guilty to resisting or hindering a police officer over the Shady Palms incident, while Josh also pleaded not guilty to common assault and assaulting a police officer.

The three brothers’ solicitor, leading Central Coast criminal lawyer, Samar Singh-Panwar instead made an application to essentially “dispense” with their bail conditions.

He said they had been subject to bail since October last year over the alleged Mumbo Jumbo’s incident which had been “following” the criminal proceedings in relation to the alleged Shady Palms brawl.

He said Magistrate Daniel Covington had retired to consider the evidence in the Shady Palms matter and was due to give his judgment on February 10.

Mr Singh-Panwar told the court once that matter had been finalised, he and the Police Prosecutor “will be able to finalise an agreed set of facts” in relation to the Mumbo Jumbos incident for Tom and Josh.

Magistrate Robert Munro agreed to vary the brothers’ bail by removing all conditions — including an order banning them from consuming alcohol — except that they continue to reside at their current addresses.

Tom and Josh’s intimidation charges were adjourned to February 23 for sentence at Gosford.
