Sacking for offensive comments was wrong, tribunal rules

A mining worker sacked for repeatedly taunting his colleague with an offensive comment was unfairly dismissed because he was not properly trained in new psychosocial safety policies, a tribunal has ruled.

The Fair Work Commission found a veteran truck driver at Phosphate Resources’ Christmas Island mine was validly sacked for bullying, including joking about “sucking the boss’ dick” and then humiliating his co-worker when told to stop.
