Court boosts de facto partners’ rights to share in joint property

Family contributions are as big a factor as financial commitments when courts decide how real estate will be divided between couples living together.

The rights of those living together to an equal split of shared real estate – despite one side not being able to prove any financial contributions – have been strengthened by a NSW Supreme Court judgment.

The decision comes as the rising number of de facto relationships continues to offset a sharp fall in traditional married relationships, despite the increased risk of eventual separation, analysis by the Australian Institute of Family Studies reveals.
