Choosing a High Court judge is hard enough. But on February 11 this year, the task became a lot more complicated.

In the most contentious decision since Mabo, the court ruled 4-3 in Love v The Commonwealth that a non-citizen who passed an Aboriginality test could not be deported under migration character laws.
