Serial crim weeps as alleged attempted murder bail falls flat

Despite being on bail when he was allegedly part of a terrifying shooting last month, a serial criminal wept as he realised he would not be getting bail again.

The staggering criminal history of a young man charged with attempted murder over a Royal Park shooting last month has been revealed as he asks the court to release him.

And as a police prosecutor detailed his 10-year criminal history and the likelihood of his bail being rejected increased, Kurt Francis Kernahan began weeping.

Kernahan’s showing of emotion came as a police prosecutor told the court he was on bail and facing sentencing over other serious offences at the time of the alleged shooting.

Kernahan on Friday was making an application, through his barrister Martin Anders, to be released on home detention bail.

Mr Anders told the Port Adelaide Magistrates Court his client should be released given strong family support and a job as a construction worker was waiting for him outside of prison.

A consideration, Mr Anders said, was the “tragic” death of Kernahan’s father eight years ago which saw him spiral into drug addiction.

The court heard despite facing a charge of the attempted murder of John Gabby Rahme, on the police’s allegations Kernahan had not fired the shot or been found in possession of the gun.

Kernahan was arrested alongside his girlfriend, 22-year-old Tiana Zenari, and charged with attempted murder after the pair were at large for 12 days following the alleged shooting of Mr Rahme.

During a court appearance for Ms Zenari, who is charged with aiding and abetting attempted murder and failing to truly answer questions, details of the shooting were revealed.

A police prosecutor alleged Ms Zenari was waiting in a getaway car near Mr Rahme’s Royal Park workshop while Kernahan, Tyrone James Doyle-Tarrant, 44, and Troy Richard Trengove, 51, carried out the alleged shooting.

Doyle-Tarrant and Trengove are both also charged with attempted murder.

The court heard Trengove had allegedly fired the gun – an improvised “Zip” pistol – while Kernahan and Doyle-Tarrant attempted to smash through the front door of the workshop.

Mr Rahme was rushed to the Royal Adelaide Hospital on January 17 with a bullet wound to his shoulder.

On Friday, as Mr Anders finalised his submissions, Magistrate Luke Davis foreshadowed his trepidation of releasing Kernahan given his criminal record.

“His (bail compliance) has been pretty poor,” he said.

“He has a significant and ongoing history and he’s only 29.”

The police prosecutor went on to details Kernahan’s 10-year history which included 47 drug, driving and “street” offences.

They included aggravated assaults, possessing weapons and thefts.

Kernahan, of Manningham, had also been convicted of breaching his bail 14 times, including by cutting off his home detention ankle monitor in April 2021 and going on the run.

The prosecutor said the most significant factor to consider was that the alleged shooting was carried out when Kernahan was already on bail and awaiting sentencing in the District Court for a serious criminal trespass and theft.

Mr Davis denied Kernahan’s application and remanded him to next face court in May.
