A 36-year-old father of two who spat on two Toowoomba hotel security guards has been fined and shamed in the city’s Magistrates Court.

Terry Alan Brewer had been at Tatts Hotel in Toowoomba’s CBD about 10pm, December 9, 2022, when he became embroiled in an argument with security.

Patrolling police arrived to find two security guards marching Brewer out of the hotel during which he had spat, with the spittle hitting both security officers, police prosecutor Cameron Francis told the court.

When asked about it by the police officers, Brewer said he had “spat near them but didn’t mean to spit on them”, he said.

Mr Francis said it was accepted that the defendant had only spat once with the spit hitting both security officers.

“It’s a disgusting act to do let alone on someone just doing their job,” Mr Francis submitted.

Brewer pleaded guilty to two counts of common assault.

His solicitor Claire Graham, of Skuse Graham Lawyers, told the court her client accepted it was “disgusting behaviour” for which he was “extremely remorseful”.

Ms Graham said her client explained he had been with an ex-partner that night at Tatts Hotel but when she became upset and walked outside he had put down his drink and gone out to see what was wrong.

It was when her client was re-entering the hotel that the altercation arose, she said.

Magistrate Kay Phillipson convicted and fined Brewer $850.
