Toowoomba truck driver guilty of indecent treatment of child under 15

A 50-year-old Darling Downs man who preyed upon a girl has been sentenced to a community-based order for the deplorable crime.

A Darling Downs truck driver who pleaded guilty to preying upon a girl has been sentenced to a suspended jail term.

Robert Jon Kajewski, 50, fronted the Toowoomba District Court in June and pleaded guilty to the procurement of a child under the age of 16 and committing an indecent act.

The court heard the former Roma and Charleville man had an unrelated and dated criminal history.

Crown prosecutor Abby Kong said Kajewski pestered the teenager throughout the evening, pressing himself against her and making inappropriate comments, and preyed upon the girl while she pretended to nap on a couch.

Ms Kong said Kajewski used the girl’s hand to grasp at his genitalia and whispered to her, “I know you like it,”.

The girl reported the incident straight away.

Barrister Doug Wilson said Kajewski had drunk a bottle of rum and two beers and had no recollection of the incident.

He noted when asked if he had touched the girl during a police interview, he said, “I’m very sorry… I can’t remember a lot… I don’t know mate, I don’t know,”.

Mr Wilson noted Kajewski was in a long-term relationship and had never been before the court for a like crime despite being in his 50s.

Judge Dennis Lynch KS told Kajewski his offence was serious, especially for his own sexual gratification.

Mr Lynch said the devastating effect the crime had on the girl would likely stay with her for some time.

However, he said the crime was at the lower end of the criminality scale when it came to the indecent treatment of a child, noting the behaviour of Kajewski was out of character and he was a low-risk offender.

Mr Lynch said he was persuaded by Mr Wilson that although Kajewski served no time for the crime, exceptional circumstances were met to veto the legislation provisions that required jail terms to be imposed for child sexual offenders.

Kajewski was sentenced to a five-month jail term, suspended for 12 months.
