There has been a minor delay in the high-profile murder case of Thor Morgan, who was shot in the head while driving on Ruthven Street, Toowoomba in March 2022.

Three people were charged in relation to the alleged murder; Lachlan Mark Freund, 26, Isobel Rose Higgins, 24, and Tina Kathleen Hazard, 36.
Police alleged Ms Higgins provided a false alibi for Freund, however the charges were dropped on September 11, 2023.

Police allege Mr Freund was being driven by Goondiwindi woman Tina Hazard when he fired the fatal shot at Mr Morgan.

Their charges remain before the courts.

Mr Freund had his case set down for a directions hearing at the Toowoomba Magistrates Court on Monday, October 16, where it was anticipated Mr Freund’s legal team would apply for a committal hearing with cross-examination of a witness, however his lawyer was not prepared.

Magistrate Kay Philipson told Brisbane-based lawyer Abdul Rashidi she was “most displeased” the lawyer had not filed the application, nor notified the court that the hearing was not to proceed.

Thor was allegedly gunned down while driving on Ruthven St near Downlands College in the early hours of March 15, 2022, and the 25-year-old died in a Brisbane hospital two months later.

Ms Philipson told Mr Rashidi he had wasted valuable court time, noting trial sittings were hard to come by this late in the year.

Mr Rashidi said there was a “mix up” and repeatedly apologised to Ms Philipson.

The court was told police prosecution attempted to get in contact with Mr Rashidi after they did not receive the documents, however he could not be reached, nor did the firm respond to their inquiry.

Ms Philipson ordered the documents to be handed over to the prosecution before October 20, noting prosecution had until November 3 to respond.

The case was set down for another directions hearing on November 24.
