Morgan Western Troy Mundey sentenced after 597 days in pre-sentence custody

After spending 597 days in pre-sentence custody, a Toowoomba man was sentenced for 26 offences committed in 2022, as the court heard the details of the drug-addled spiral which led to his offending.

A 45-year-old man was sentenced in Toowoomba Magistrates Court on more than 26 charges.

Morgan Western Troy Mundey appeared via videolink in the Toowoomba Magistrates Court from Borallon Training and Correctional Centre on Friday, where he had spent the past 597 days.

The 45-year-old was in pre-sentence custody for the 26 matters before magistrate Lisa O’Neill on August 9, and serving time for matters which were finalised in the Toowoomba District Court on June 10, 2024.

Mundey pleaded guilty to all 26 charges, which ranged from fraud, entering a premises and committing an indictable offence, unlawful use of a motor vehicle, drug offences, stealing and weapons offences.

One of the offences was the burglary of a number of jewellery items at a Buderim address on December 6, 2022, police prosecutor Chris Wilson said.

Some of the jewellery was recovered by police during a search of a Bli Bli address.

Senior Constable Wilson said Mundey should serve between 12 to 18 months for that offence.

The court was told of the 45-year-old’s prejudicial personal situation, and that before his spate of offending in 2022, he had proven to be a contributing member of society for close to a decade.

Ms O’Neill described some of the things which had happened in Mundey’s recent history as “truly tragic”.

“They obviously caused you extreme distress,” she said.

“They included the murder of your brother, the death of a parent, the breakdown of your relationship.

“That resulted in you using illegal substances and these have obviously played a really negative role in your life.”

During his time in custody to date, Ms O’Neill said Mundey had completed “various courses” and had “good prospects of rehabilitation”.

Ms O’Neill said the head sentence should be applied to the charge of entering premises and committing an indictable offence on December 6, 2022, and sentenced him to 16 months imprisonment.

He received further sentences for his other offences, aside from failing to appear of which he was convicted and not further punished.

Ms O’Neill set Mundey’s parole eligibility date as December 22, 2024, to line up with the parole eligibility date set in Mundey’s district court sentencing in June, where he was sentenced for his involvement in a six-hour siege in Toowoomba’s west.
