The case of a 25-year-old man accused of shooting Thor Morgan as he drove on Ruthven St north has taken a major step forward after the matter was mentioned in Toowoomba Magistrates Court on Monday.
Lachlan Mark Freund was not required to be in court but was represented by his solicitor Abdul Rashidi, of Alexander Rashidi Lawyers, who appeared via telephone.
Mr Rashidi said he was still waiting for some outstanding material including DNA and ballistics reports.
However, police prosecutor Bettina Trenear said there was a note on the file indicating the statement was available but she would have to check it was the same DNA statement the parties were discussing as well as seek an update on the ballistics report.
Mr Freund has not as yet been required to enter any pleas to charges of murder arising from the death of Thor Morgan, who was allegedly shot while driving on Ruthven St near Downlands College in the early hours of March 15, 2022 as well as to unlawful use of a motor vehicle and arson of a motor vehicle allegedly relating to the car he was in and to unlawful possession of a weapon allegedly used.
Police allege Mr Freund fired the shot that hit Mr Morgan while co-accused Tina Hazard, 36, drove the vehicle.
Ms Hazard has also been charged with murder and remains in custody as her case proceeds through the same court.
Magistrate Clare Kelly said she would adjourn Mr Freund’s case for just two weeks in the hope by then there would be an update on the availability of the outstanding reports.
She remanded Mr Freund in custody and adjourned the matters for committal mention back in the same court on August 14.
