Heavily redacted witness statements have forced another delay in the case against three people accused of being involved in the death of Toowoomba man Thor Morgan.
The 25-year-old was allegedly shot in the head while driving on Ruthven St in Harlaxton in the early hours of March 15, 2022, dying in hospital two months later.
Lachlan Mark Freund, 24, and Tina Kathleen Hazard, 36, have both been charged with murder in relation to Mr Morgan’s death while Isobel Rose Higgins, 24, has been charged with being an accessory after the fact of murder.
All three were not required to be in Toowoomba Magistrates Court on Friday when their respective charges were mentioned.
Solicitor Julia Molloy, representing Mr Freund and Ms Hazard as town agent, and solicitor Nathan Bouchier, representing Ms Higgins, told the court that while briefs of evidence had been received, witness statements had been heavily redacted which would cause “significant complications” at any potential directions hearings.
Further complicating matters, Ms Molloy told the court that Mr Freund had withdrawn his instructions to solicitors at Phillips Crawford Lawyers and was seeking new legal representation.
Magistrate Kay Philipson expressed frustration that the case was in a similar position to when it was last mentioned in March.
Police prosecutor Natalie Bugden told the court she would take the matter up with the acting officer in charge.
Ms Philipson adjourned all matters for the three co-accused to May 11.
Due to Mr Freund’s change in legal teams, Ms Philipson ordered that he appear via video link at the next occasion and remanded him in custody.
Ms Hazard was also remanded in custody while Ms Higgins’ bail was continued.
