Outstanding police material was again blamed for the delay in court proceedings of a 30-year-old man charged with murder arising from a Christmas Day incident at Millmerran.
Callum Anthony Padaric Cook is accused by police of deliberately driving at 55-year-old Russell Klein in the front yard of his property about 9pm, December 25, 2022.
It is alleged the incident occurred following a disturbance at a Commens St residence.
Police claim Mr Klein, a well-known Darling Downs rugby league identity, sustained critical injuries from which he died despite efforts of paramedics to revive him at the scene.
Police found Mr Cook at a nearby park a short time later and he was arrested and taken into custody.
He has not as yet been called upon to enter any plea to the charge of murder or to related matters of unlawful possession of a weapon, ammunition and drug utensils, and unlicensed driving.
Legal Aid Queensland solicitor Nikola Prince, for Mr Cook, told the court on Wednesday she had received further police material provided prior to court but she was still waiting for other police statements, a pathologist’s report and a ballistics report.
Magistrate Kay Philipson said the police statements at least should be available by this time.
Ms Philipson adjourned the case for mention back in the same court on April 19 by which time it was expected the court would be informed as to where all reports and statements were.
Mr Cook was remanded in custody with his appearance at the next mention excused.
