A drunk 30-year-old man who got inside a closed Ruthven St eatery and helped himself to cash before causing serious damage has been handed a jail term and ordered to pay compensation.

Daniel Alan Killington was captured on CitySafe cameras leaving Tatts Hotel about 2.30am, July 31, Toowoomba Magistrates Court heard.

CitySafe cameras filmed him walking along Ruthven St where he entered the Phat Burgers cafe through a closed but unlocked door, police prosecutor Chris Willson told the court.

Inside he smashed a cash register from which he took cash estimated to be “at least $800” and then broke a number of drink bottles during which he cut himself, Senior Constable Willson said.

His wound left a considerable amount of blood on the floor and on food which had to be thrown out, he said.

A Phat Burgers staff member’s iPad had also been taken, the court heard.

Snr Const. Willson said the complainant business was seeking $1500 in compensation.

Killington pleaded guilty to entering a premises and committing an indictable offence.

Duty solictor Joe McConnell told the court Killington had an alcohol problem for about the past 10 years and drank to the point of blacking out.

Killington had received his tax benefit money which he had used to drink that night and he had little recollection of events, he said.

The 30-year-old was working up to 60 hours a week as a kitchen hand at a city hotel and would pay compensation, Mr McConnell said.

Acting Magistrate Rowan Silva sentenced Killington to six months in jail but ordered the whole term be suspended for 15 months and ordered he pay $1500 compensation.
