Toowoomba man Atem Gabriel Deng, 20, delays sentence to fit new criminal charges

A man convicted of defrauding the government out of more than $20,000 was warned about seeking to further delay his sentencing.

A convicted tax fraudster has been warned against asking to further delay his sentence in line with new charges.

Toowoomba man Atem Gabriel Deng, 20, appeared before Toowoomba Magistrates Court on Wednesday where he was due to be sentenced for multiple offences.

Throwing a spanner in the works, Mr Deng requested the matter be delisted in order to accommodate upcoming additional charges.

“Mr Deng has some fresh matters and is on a notice to appear on October 29,” his solicitor Sean Gallagher from Skuse Graham Criminal Lawyers said.

“He was charged with those on Monday.”

Mr Deng was before Toowoomba District Court only one month ago for defrauding the Australian Taxation Office of more than $20,000.

He was sentenced to 12 months imprisonment with immediate parole and placed on a good behaviour bond for two years.

Mr Deng’s fresh charges are believed to have been committed prior to his district court sentencing.

Magistrate Kyna Morice agreed to adjourn the matters for reasons of totality but cautioned against continuing delays.

“Can I make it very clear to Mr Deng that if he is going to keep committing offences I’m not going to keep adjourning his sentence so that he can’t be dealt with for anything,” she said.

“If he chooses then to continue to commit offences, potentially in contravention of court orders, then that will make his position worse.

“There will come a time where (totality) is overridden by other factors.”

He was formally charged with one count each of possessing utensils and pipes; authority required to possess explosives; contravening a police direction; using a carriage service to menace, harass or cause offence; contravening a police banning notice; contravening a domestic violence order and two counts each of contravening order about information necessary to access information stored electronically and possessing dangerous drugs.

He will appear again in Toowoomba Magistrates Court on October 29, 2024.
