A Whitsunday father who is facing 15 charges of drug offending including supplying MDMA, has sought bail with his solicitor saying he could be at risk of spending too much time in custody.

Joshua Ronald Dagan, 28, faced Proserpine Magistrates Court for more drug related offences after spending over seven months in custody for similar offences he was sentenced for last year.

The charges before the court include obstructing a police officer, several charges of drug possession and of supply.

Prosecutor Sergeant Emma Myors told the court the risk for Mr Dagan to reoffend once released on bail was “unacceptable” since it was not the first time, as he had been caught with drugs on various occasions since 2012.

Sergeant Myors said the last time Mr Dagan was placed on parole, services had found drugs on him within two months after his release.

She told the court there was no reason to believe the same thing would not happen again.

“He’s a person before your Honour, who based on his history, does not comply with orders,” Sergeant Myors said.

Solicitor Rosemary Varley told the court Mr Dagan had already spent 213 days in custody, and had used his time there to work as a cleaner.

Ms Varley said her client should have been released on parole on March 22, but it had not been the case as he was facing the new charges.

She told the court he could reside with his partner in Airlie Beach, with whom he had remained in a relationship while in custody.

Ms Varley argued before Magistrate Michelle Howard that terms of imprisonment should be a last resort for drug offences.

Magistrate Michelle Howard told the court she would grant Mr Dagan bail as he had already spent too much time in custody.

She told Sergeant Myors the fact that he was an unacceptable risk had already been admitted.

Mr Dagan was granted bail on the conditions that he report twice a week at the Cannonvale Community Centre.

His case will be next mentioned on May 27.
