Keith Lewis Payne sentenced for wilful damage in Bowen court

When his partner held firm on their breakup, a father of three went wild, destroying her belongings including her underwear.

A father of three made “some very stupid moves” when his partner of 10 years remained intransigent on the decision to break up.

Keith Lewis Payne, 32, pleaded guilty in Bowen Magistrates Court to wilful damage after an argument with his ex-partner led him to an outburst at a property on February 19.

Police Prosecutor, Sergeant Linden Pollard told the court their argument had escalated on that day when Payne threw her phone on the floor, before smashing her mirror, and then taking her sunglasses and breaking them in half.

Ms Pollard added he had also damaged some of her underwear as well as a family photo in the process.

Defence solicitor Maria Christian told the court this was out of character for Payne as he had no criminal history.

She told Magistrate Michelle Howard her client had made “very stupid moves” when his ex-partner told him she would not consider mending their 10-year relationship.

Magistrate Howard told Payne this was “completely unacceptable”, and that the context did not justify his actions.

“If you have problems with anger, I urge you to deal with them,” she said.

Payne was fined $350 and ordered to pay a restitution sum of $535.

A conviction was not recorded.
