Newly published court documents have revealed a former nightclub co-owner’s role in a bustling cocaine dealing business which funded his lifestyle.

In sentencing remarks published by the Supreme Court of Queensland this month, Shea Daniel Bartholom Fox was told he was “commercially motivated” in the drug trade which enveloped the popular Rolling Rock nightclub at Noosa Heads back in 2021.

Court documents say the Noosa man was busted during a search warrant on the venue, now known as Aqua Lounge and Nightclub under different owners, where he was found with six bags of cocaine.

Justice Catherine Muir told the court last year the drugs were of “varying low degrees of purity”, with there being only 1.001g of pure cocaine in 5.945g of substance.

Drug related messages were then uncovered on Fox’s phone, and the 32-year-old told police he had a drug problem.

The Supreme Court judge said it was later revealed he was part of a “larger business”, overseen by nightclub co-owner Marcus Wright.

Justice Muir said Fox primarily supplied cocaine at a retail level, with there being occasional supplies of commercial quantities. She said the business supplied cocaine in quantities between one to two gram per bag.

The court was told the proceeds from Fox’s slice of the business, which ran from May 2020 to March 2021, were put towards his drug habit and his lifestyle expenses, where he even bought himself a new car.

Justice Muir said Wright was jailed for five years, suspended after serving 15 months, for his role in the drug trafficking operation, after pleading guilty to one count each of trafficking dangerous drugs, possessing a phone used in a crime, and fraud.

She however acknowledged Wright had greater criminality in the business.

On balance, the Supreme Court Judge said Fox had completed considerable rehabilitation, and acknowledged his prejudicial upbringing.

She said since he was charged, the 32-year-old was involved in mindset coaching, physical training and had started his own cleaning company.

Instead of actual imprisonment, Justice Muir said Fox had excellent prospects of rehabilitation which would be better served in the community with his support network.

Fox pleaded guilty to trafficking in dangerous drugs, possessing a dangerous drug and possessing things used in connection with the commission of trafficking drugs, and was sentenced to three years’ jail.

He was given immediate parole.
