Nicholas Felice Bevacqua denied bail over alleged stalking

A Moffat Beach carpenter and former business owner allegedly followed a woman in her van and hid under the vehicle, telling her she would never get rid of him.

A tradie and former business owner has been denied bail after he allegedly stalked a woman and told her she would never get rid of him.

Nicholas Felice Bevacqua, 42, appeared on video link in the Maroochydore Magistrates Court on August 26 with duty lawyer Ben Rynderman applying for bail on his behalf.

He has been charged with one count of unlawful stalking and one of common assault.

Magistrate Haydn Stjernqvist read from a report by the alleged victim, which stated on August 15 she was travelling through Moffat Beach and had pulled over to clean her glasses.

The court heard it was at this time the woman allegedly saw Mr Bevacqua by the back corner of her van on an electric bicycle.

Mr Stjernqvist read out the woman believed he had followed her from her workplace as she had not parked near his residence.

It is alleged Mr Bevacqua said “you are never going to get rid of me” to the woman when she wound down her window and asked him if he was stalking her.

After driving away and stopping elsewhere, the woman heard a noise, exited the vehicle to investigate and found Mr Bevacqua allegedly lying underneath her van, Mr Stjernqvist said.

Police prosecutor Mark Burrell opposed bail, reasoning Mr Bevacqua “can’t seem to leave her alone” with the risk of further offending.

Mr Rynderman told the court the matters were “of concern” and would have to be finalised within the District Court.

He said Mr Bevacqua was a father and works as a carpenter, and had previously run his own business.

Mr Rynderman said the Moffat Beach man had alcohol issues at the time and he had recognised he had problems and hoped to get help for himself.

Mr Stjernqvist ultimately refused bail and adjourned the matter to October 18.
