A Sunshine Coast mother-to-be was angered by a security guard, who poked her tongue out, when she grabbed the woman by the throat and spat in her face.

Serious assault, Noosa

A Sunshine Coast mother-to-be overreacted when she grabbed a security guard by the throat and spat in her face for poking her tongue out.

Jessica Lee Voice was fined $800 for assaulting a Post Office Security Guard at 1.50am on October 21.

Police prosecutor David Hoffman told the Maroochydore Magistrates Court Voice was being evicted from the Ocean Street venue when she lashed out at a female security guard.

“ … (Voice) grabbed the victim by the throat with her right hand and the victim felt a squeeze and immediate pain,” Senior Constable said.

“(She) … turned her head and while yelling towards the victim spit has landed on the victim’s face.”

Constable Hoffman said Voice grabbed the victim by the throat on two occasions and asked for Voice to be banned from the Maroochydore Safe Night Out precinct.

Voice pleaded guilty to one count of assault in Maroochydore Magistrates Court on Friday.

The court heard Voice had limited criminal history that included an obstruct police charge from 2014.

Defence solicitor Lisa Taylor said the 34-year-old, who was pregnant at the time of the attack, was agitated by the actions of the security guard.

“The victim has poked her tongue out at … (Voice) and that’s when she then grabbed her by the throat,” she said.

Ms Taylor said Voice also felt protective of her long-term partner who she believed was being “manhandled” by security.

She said Voice worked as a team leader in the mental health and disability sector and volunteered to help homeless people at a Nambour church.

The court heard Voice took responsibility for the assault and would lose her Blue Card and job if Magistrate Haydn Stjernqvist recorded a conviction.

Ms Taylor said Voice needed to go to Ocean St for work and asked for her not to be banned from the Safe Night Out precinct.

She described Voice as having a good character and asked for a fine to be imposed.

Mr Stjernqvist questioned how the security guard’s tongue could possibly anger the soon-to-be mother into grabbing her by the throat.

He said spitting on the security guard was a degrading act.

Mr Stjernqvist said Voice could have been given a suspended sentence for the behaviour.

Voice was ordered to pay $200 in compensation to the security guard.

She was not banned from the popular nightclub strip and had no conviction recorded.
