Jeremy William Lindsay pleads guilty to exposing himself to children at Nambour

A creep with a history of exposing himself in public has continued his ‘revolting’ behaviour by touching himself in front of three children.

A Nambour man with a history of exposing his genitalia in public has escaped a certain stint behind bars after he touched himself in front of three children passing his home.

The three children, aged between 11 and 13, were walking down a Nambour street on November 15, 2023 when they spotted Jeremy William Lindsay sitting on a stool in his car port.

Crown prosecutor Rebecca Marks told Maroochydore District Court on Monday how when the 40-year-old emerged from underneath a large shade sail, the children could see his shorts were at his knees.

Ms Marks said Lindsay could be seen masturbating for three seconds which prompted the children to yell out “ew” in the hope he would stop.

The court was told one of the children tried to take a photograph of Lindsay with their phone however he quickly pulled his pants up, made a “strange” hand gesture to them and went back inside.

Ms Marks said the children reported what they saw which prompted police to visit Lindsay’s home who gave a false account of what happened.

He also labelled the allegation “despicable” and gave a fake alibi which was quickly debunked by police.

Lindsay was arrested days later and charged with three counts of indecent treatment of children. He pleaded guilty to all three charges in court on Monday.

Ms Marks labelled the 40-year-old’s behaviour as “revolting”, and referenced similar offences of wilful exposure on his criminal history. She asked for him to serve time behind bars.

Defence barrister Mark Dixon however claimed there were exceptional circumstances which meant Lindsay should not spend a period in custody, which was mandatory for his offences.

Mr Dixon said the “abhorrent behaviour” was rather opportunistic where did not seek out the children.

The barrister said Lindsay suffered from a very serious mental illness and a brain injury, which meant he required more supervision. This was being done under the National Disability Insurance Scheme.

He said Lindsay’s mental health and cognitive deficits meant the 40-year-old needed to stay in the community to receive appropriate supports.

Judge Michael Williamson KC said the acts were “gross” and “disturbing” but agreed there were exceptional circumstances, and believed the Nambour man would be a “vulnerable inmate” in custody.

He instead jailed Lindsay for 18 months’, which was suspended immediately for the same period.

The 40-year-old was also placed on an 18 month probation order with a conviction recorded.
