Chapel of Angels Pty Ltd ordered to bring in liquidators

The company behind a Sunshine Coast wedding venue, which was engaged in a legal dispute with a builder for nearly 10 years, has been ordered to bring in liquidators.

The company behind a Sunshine Coast hinterland wedding venue has collapsed after becoming embroiled in a drawn-out court battle with its former builder.

A Supreme Court order issued on Thursday, March 21, appointed liquidator Marcus Watters of Hall Chadwick to the company behind a Montville wedding venue, Chapel of Angels Pty Ltd.

It is not yet known if there are any debts owed to creditors of the company.

The wedding venue company and the builders, Hennessy Building Pty Ltd, were involved in numerous court battles since 2014, including a seven-day trial, after the construction of the chapel in Montville turned bitter when it was revealed the builder did not have the correct licence to complete a two-storey project.

According to court documents the issue arose when the director of Chapel of Angels refused to pay for a portion of the work completed by Hennessy and wanted the amount that had already been paid to be repaid.

Ultimately, a 2018 court decision in civil proceedings brought by Chapel of Angels, ordered the wedding venue to pay part of the money owed for the job and for a portion of the legal costs to Hennessy.

The company was not ordered to pay for the work completed without the proper licence.

“On 11 December 2018 his Honour ordered that Chapel pay a judgment of $85,989.86 to Hennessy. His Honour further ordered that Chapel pay 75 per cent of Hennessy’s costs of the proceedings,” the documents stated.

The court documents stated the legal costs were estimated to be $385,ooo.

Chapel of Angels then brough new civil proceedings in the Supreme Court and attempted to get $1.6m from Hennessy in 2022, arguing documents had been withheld fraudulently during previous District Court proceedings.

However in June 2022, Justice Peter Flanagan ordered the Chapel of Angels claim be set aside and found there was no evidence of the fraud Hennessy was alleged to have committed.

“I accept Ms Nicholas’s submission that the ‘very serious allegations of fraud contained in the statement of claim, made against legal practitioners, are baseless and unsupported by evidence’,” Justice Flanagan said.

Justice Flanagan also struck out the statement of claim, which sought for the chapel to be relieved of paying any previous District Court orders.

The property at 14 Kondalilla Falls Rd, Montville is currently listed for sale, advertising the current chapel that can host up to 80 guests as well as scope for possible accommodation additions, pending council approval.

The property was also offered for auction last year.
