A Central Queensland man was beaten up inside his caravan by two brothers after refusing their request to join them socially after he interrupted them harassing his parents.
Aiden Lee Milne, 24, and his brother Bryer Earl Milne, 31, pleaded guilty in Rockhampton District Court on April 27 to one count of burglary, one of threatening violence at night and one of wilful damage.
Crown prosecutor Caleb Theunissen said the victim first came upon the brothers when they attended his parents’ Mount Morgan residence on May 25, 2022, harassing them, and the victim was called to help.
“He arrived home to find the defendants assaulting his parents and acting erratically,” he said.
“The defendants invited the victim to their house to smoke marijuana.”
The victim managed to calm down the brothers, who lived a few houses down the road, and they eventually left.
However, they returned at 2.30am and banged in the victim’s caravan door for five minutes, waking him up and denting the door.
The intoxicated pair entered the caravan, blocking the exit, and verbally abused the victim as he lay in bed.
The court heard they asked the victim to join them at their house, but he refused, so they threatened to kill him and “split the victim open with a cut throat blade” before repeatedly punching him in the stomach.
Mr Theunissen said there was a lack of a coherent reason for the assault, other than the victim not wanting to hang out at 2.30am.
“I think they were, in their own peculiar way, seeking out friendship,” Bryer’s defence barrister Jordan Ahlstrand said.
The court heard both men had mental health issues such as attention deficit hyperactivity disorder, bipolar disorder, autism and language disorder with Bryer on a disability support pension.
Aiden had no criminal record prior to this offence, but Bryer had a two-page record with 13 entries for drugs, public nuisance and wilful damage.
Aiden was sentenced to 18 months prison, wholly suspended and operational for 18 months.
Bryer was sentenced to 20 months prison with immediate release on parole.
