Gary Murphy makes bid for bail in Rockhampton Magistrates Court

A prosecutor has told a court a would-be labourer charged with stealing tools and trying to sell them as if they were his own has “difficulties” following court orders.

A man who allegedly broke into vehicles and stole tools before trying to sell them has had his bid for bail quashed.

Gary Robert Murphy, 32, made an application for bail when he appeared from the dock of Rockhampton Magistrates Court on Wednesday, July 3, after spending a night in the watchhouse.

He was charged with a number of alleged offences including possessing dangerous drugs, offence to buy or possess s4 of s8 medicines or hazardous poisons, possessing utensils or pipes that had been used, break and enter and attempted fraud.

Police prosecutor Brandy Butler objected to his bail, telling the court Murphy had “little in his favour” when it came to trying to convince Magistrate Grace Kahlert.

Ms Butler told the court Murphy had previously breached probation orders, suspended sentences and release conditions, showing he had “difficulties” following orders given to him.

Murphy’s lawyer Samantha Legrady told the court while her client did have a five-page criminal history he had no entries for breaching bail or failing to appear.

Ms Legrady told the court Murphy was hoping to get work as a labourer in the near future.

She said if her client did plead guilty to the alleged offences there was a chance he may not spend actual time in custody and said there were a range of penalties that could be imposed such as probation, suspended sentences or immediate parole.

Ms Legrady said her client was willing to abide by a number of bail conditions including living at a certain address, reporting weekly to a police station and abiding by a curfew.

After considering submissions from both sides Magistrate Grace Kahlert was not satisfied Murphy had shown cause as to why spending more time in custody was not justified.

Murphy’s bail was refused and he was remanded in custody.

Hi matters are expected to be mentioned in court again on July 24.
